1. Introduction & Acceptance of Terms

Welcome to Nano Banana 2.1 (the "Service"), available at nanobanana-21.cc. The Service is operated by an individual sole trader ("we", "us", "our").

These Terms of Service ("Terms") govern your access to and use of the Service, which lets you generate images from text prompts (and optional reference images) using AI.

By creating an account, subscribing to a plan, purchasing Credits, or otherwise using the Service, you confirm that you: (a) are at least 18 years of age; (b) have read, understood, and agree to be bound by these Terms; (c) agree to our Privacy Policy; and (d) are authorized to enter into this agreement for yourself or any organization you represent.

If you do not agree to these Terms, you may not use the Service. Continued use after an update constitutes acceptance of the revised Terms.

2. Description of Service

2.1 What we provide. Nano Banana 2.1 is an online tool that generates images from your prompts. It is a digital software-as-a-service (SaaS) product delivered over the internet.

2.2 Nature of the Service. The Service is a digital, intangible product. Access is granted once payment is confirmed. Because of this, refunds are subject to Section 7.

2.3 Third-party AI dependency. Image generation relies on third-party AI model providers. The performance and availability of the Service may be affected by the status of these providers. We may add, remove, or change the providers and models used at any time.

2.4 Independent service. The Service is an independent tool. It is not affiliated with, endorsed by, or sponsored by Google. Google, Gemini and Nano Banana are trademarks of their respective owners, and model names are used only to describe the models the Service makes available.

3. Account Registration

3.1 Account creation. Using the Service requires an account with accurate and complete information. You can sign up with an email address and password (email verification is required) or, where available, with Google. You are responsible for keeping your login credentials confidential and for all activity under your account.

3.2 Account security. If you discover unauthorized use of your account, contact us immediately at support@nanobanana-21.cc. Do not share your credentials with any third party.

3.3 Organizational accounts. If you register on behalf of a company or organization, you represent that you are authorized to bind that entity to these Terms.

4. Free Allowance, Plans and Credits

4.1 Free allowance. Each account receives one free image generation, once, for the lifetime of the account. Creating multiple accounts to obtain additional free generations is not permitted.

4.2 Credits. Beyond the free allowance, the Service is used with Credits. Credits are product units, not money, and have no cash value. The number of Credits a generation uses depends on the resolution you choose and the number of reference images you add; this is shown in the Service. If a generation fails, the Credits it used are returned to your account.

4.3 Plans and packs. We offer subscription plans (Starter, Pro, Studio), billed monthly or yearly, and separate one-time Credit packs. Current plans, Credit amounts, and prices are shown on our pricing page. We may modify plans or introduce new ones at any time; price changes are subject to Section 5.1.

4.4 Credit expiry.

• Monthly plans: the Credits granted for a billing period expire at the end of that period and do not carry over.
• Yearly plans: the year is charged up front, and Credits are granted month by month. Each month's Credits expire at the start of the next monthly period and do not accumulate.
• Credit packs: Credits expire 12 months after purchase.

4.5 How Credits are used. When you generate an image, Credits that expire soonest are used first.

5. Billing and Payment

5.1 Subscription auto-renewal. By subscribing to a paid plan, you authorize us, through our payment processor, to charge your payment method on a recurring basis for the applicable fee until you cancel under Section 6. Subscriptions renew automatically at the end of each billing period (monthly or yearly) unless canceled.

5.2 Credit pack purchases. Each Credit pack is a one-time transaction. Completing a purchase authorizes us to charge your payment method for the amount shown at checkout.

5.3 Payment processing. Payments are handled by a third-party payment processor. We do not store your full card details.

5.4 Taxes. Unless stated otherwise, prices do not include applicable taxes. Where required by law, taxes will be collected at checkout.

6. Cancellation

6.1 How to cancel. You can cancel your subscription at any time through the billing section of your account settings, or by emailing support@nanobanana-21.cc from your registered email address.

6.2 Effect of cancellation.

• Your subscription stays active until the end of the current billing period, and you will not be charged for later periods.
• For yearly plans, canceling stops renewal; Credits for the remaining months of the year you already paid for continue to be granted.
• Credits from Credit packs are not affected by cancellation and remain usable until they expire under Section 4.4.
• Unused monthly plan Credits expire as described in Section 4.4.

7. Refund Policy

7.1 General policy. Purchases of digital products, including subscription fees and Credit packs, are generally non-refundable, except where required by law or where we agree to a refund in our discretion. Nothing in these Terms limits any mandatory rights you may have under applicable law.

7.2 Effect of a refund. If a payment is fully refunded, the unused Credits that came with that payment are removed from your account, and, for a yearly plan, the remaining monthly Credit grants stop. Credits already used are not restored.

7.3 How to request a refund. Email support@nanobanana-21.cc with your account email, transaction details, and the reason for your request.

8. Billing Disputes

If you believe a charge is incorrect, please email support@nanobanana-21.cc before disputing the transaction with your bank or card issuer, so we can try to resolve it quickly.

9. AI Content and Intellectual Property

9.1 Output ownership. Subject to these Terms, the Output generated from your Input is yours to use for any lawful purpose permitted under Section 10, to the extent allowed by law and by the terms of the underlying AI providers. Because AI-generated content may not qualify for copyright protection in some jurisdictions, we do not guarantee that you will hold exclusive rights in any Output. Similar Outputs may be generated for other users.

9.2 Input license. When you submit Input, you grant us a limited, non-exclusive license to use it solely to provide the Service to you, including sending it to our third-party AI providers and storing the resulting images for you. You confirm that you have the right to submit your Input, including any reference images.

9.3 Accuracy of AI output. AI-generated content may contain errors, artifacts, or unexpected results. We do not guarantee specific output quality, and you are responsible for reviewing Output before relying on or publishing it.

10. Acceptable Use

10.1 Permitted use. You may use the Service only for lawful purposes consistent with these Terms.

10.2 Prohibited content. You agree not to use the Service to generate, request, or attempt to generate:

• Sexually explicit content, or any content that sexualizes minors. Content that endangers or exploits minors is strictly prohibited, and we may report it to the relevant authorities.
• Content that depicts or promotes graphic violence, gore, self-harm, or terrorism.
• Content that promotes hatred, discrimination, or harassment against a protected group.
• Deepfakes or content that creates a misleading or non-consensual likeness of a real person, or that impersonates a person or organization to deceive.
• Content that infringes a third party's copyright, trademark, or other intellectual property rights, or that is illegal, defamatory, harassing, or fraudulent.

10.3 Other prohibited uses. You also agree not to:

• Use another person's account, or create multiple accounts to get additional free generations.
• Circumvent or interfere with the Service's security features, usage limits, or Credit accounting.
• Resell or sublicense access to the Service without our prior written approval.
• Use the Service's inputs or outputs to train, fine-tune, or benchmark an AI model that competes with the Service, or systematically scrape or collect outputs at scale.
• Violate any applicable law or regulation.

10.4 Reporting and enforcement. To report content or account activity that you believe violates these Terms, email support@nanobanana-21.cc. We may remove content, restrict features or Credits, suspend, or permanently close accounts that violate these Terms, and may refer serious violations to law enforcement.

11. Data, Privacy, and Security

Your use of the Service is subject to our Privacy Policy and Cookie Policy. Payment card data is handled by our payment processor and is not stored on our servers.

12. Disclaimers and Limitation of Liability

12.1 Disclaimer of warranties. THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR ACCURACY OF AI OUTPUT.

12.2 Limitation of liability. TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM.

13. Term and Termination

These Terms remain in effect while you use the Service. We may suspend or terminate your account for a material breach of these Terms, suspected fraud, or as required by law. You may delete your account at any time from your account settings or by contacting us. If we discontinue the Service entirely, we will give reasonable advance notice by email so you can use your remaining Credits.

14. General Provisions

We may update these Terms at any time. Material changes will be communicated by email or a notice on the Service at least 14 days before they take effect. Continued use of the Service after that constitutes acceptance. If any provision of these Terms is found invalid, the remaining provisions remain in full effect. These Terms, together with our Privacy Policy, are the entire agreement between you and us.
